I recall being taught that an offer of a draw is made after one makes one's move rather than prior to moving, such that the opponent then considers the offer on his own time. I don't recall the rules on this, though.
In the example you give, if the draw were accepted before mate was delivered then a draw should be the result. If the mating move was played prior to the draw being accepted then it's a win.
